Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Khee Khee website, mobile application, and related services (collectively, the "Platform"), operated by Khee Khee Technologies Private Limited (hereinafter referred to as "Khee Khee", "we", "our", or "us").

By accessing, registering on, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Platform.

1. About Khee Khee

Khee Khee is a digital influencer marketing platform that connects Brands, Agencies, and Creators to discover each other, create campaigns, manage collaborations, communicate, process payments (where applicable), and access campaign analytics and related tools.

Khee Khee acts solely as a technology platform facilitating collaborations and does not become a party to agreements entered into between users unless explicitly stated otherwise.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age or have legal authority to enter into contracts.
  • Provide accurate and complete registration information.
  • Maintain the confidentiality of your account credentials.
  • Comply with all applicable laws and regulations.

You are responsible for all activities conducted through your account.

3. Platform Usage

Users agree to use the Platform only for lawful purposes. You shall not:

  • Create fake or misleading accounts.
  • Misrepresent your identity, audience, or business.
  • Use bots, fake engagement, purchased followers, or fraudulent metrics.
  • Upload unlawful, abusive, defamatory, or infringing content.
  • Attempt to reverse engineer, copy, modify, or exploit the Platform.
  • Interfere with Platform security or functionality.
  • Scrape or collect user information without authorization.

Violation of these Terms may result in suspension or permanent termination of your account.

4. Intellectual Property

The Platform, including its software, design, trademarks, logos, graphics, text, databases, AI features, and other intellectual property, are owned by Khee Khee or its licensors.

Users may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works without prior written permission.

Users retain ownership of content uploaded by them but grant Khee Khee a limited, non-exclusive, worldwide license to host, display, process, and use such content for operating and improving the Platform.

5. User Content

Users are solely responsible for content they upload or publish. You warrant that:

  • You own or have permission to use all uploaded content.
  • Your content does not violate any intellectual property rights.
  • Your content complies with applicable laws and advertising guidelines.

Khee Khee reserves the right to remove any content that violates these Terms.

6. Platform Role

Khee Khee is an intermediary technology platform. Unless expressly stated otherwise:

  • We do not guarantee campaign success.
  • We do not guarantee creator performance.
  • We do not guarantee business outcomes.
  • We do not guarantee engagement, sales, or reach.

All commercial agreements remain between participating users.

7. User Categories

The Platform may provide separate services for:

  • Brands
  • Agencies
  • Creators

Each user agrees to comply with any additional policies applicable to their account type.

8. Subscriptions and Fees

Certain Platform features may require paid subscriptions or service fees. By purchasing a subscription, you agree that:

  • Fees are payable in advance.
  • Applicable GST and taxes may be charged.
  • Subscription benefits remain available only during the active subscription period.
  • Unless otherwise specified, payments are non-refundable.

Khee Khee reserves the right to revise pricing with prior notice.

9. Campaigns and Collaborations

Brands and Agencies are responsible for:

  • Campaign details
  • Deliverables
  • Timelines
  • Budgets
  • Approvals

Creators are responsible for:

  • Delivering agreed content
  • Following campaign guidelines
  • Meeting deadlines
  • Making appropriate advertising disclosures as required by applicable laws and regulations.

Failure to fulfill agreed obligations may affect future participation on the Platform.

10. Payments

Where payment services are enabled:

  • Payments may be processed through authorized third-party payment providers.
  • Platform fees, payment gateway charges, taxes, and statutory deductions may apply.
  • Funds may be temporarily held until campaign completion or approval.
  • Payout timelines depend on verification and payment partner processing.

Khee Khee reserves the right to withhold payments during fraud investigations or dispute resolution.

11. Wallet Services (If Available)

Where digital wallet functionality is provided:

  • Wallet balances may only be used within the Platform.
  • Brands or Agencies may add funds subject to Platform policies.
  • Creator payouts may be withdrawn only after verification.
  • Wallet balances are non-transferable except as permitted by Khee Khee.

12. Refund Policy

Unless expressly stated otherwise:

  • Subscription fees are non-refundable.
  • Platform service fees are non-refundable.
  • Campaign fees are generally non-refundable after campaign activation.

Refund requests arising from incomplete deliverables or disputes will be reviewed on a case-by-case basis. Khee Khee's decision regarding Platform-managed transactions shall be final.

13. AI Features

The Platform may provide AI-powered recommendations, creator discovery, campaign insights, analytics, or automation tools.

These outputs are generated automatically and should not be treated as professional, financial, legal, or business advice. Users remain responsible for all decisions made using AI-generated information.

14. Third-Party Services

The Platform may integrate with third-party services including payment providers, analytics tools, cloud services, authentication providers, and social media platforms. Such services operate under their own terms and privacy policies. Khee Khee is not responsible for third-party systems or services.

15. Internet and Device Requirements

Certain Platform features require internet connectivity and compatible devices. Users are responsible for:

  • Internet charges
  • Mobile data charges
  • Device maintenance
  • Software updates

Khee Khee is not responsible for service interruptions caused by network providers or user devices.

16. Privacy

Use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, storage, processing, and use of your information as described in our Privacy Policy.

17. Communications

By registering on Khee Khee, you consent to receive communications through:

  • Email
  • SMS
  • WhatsApp
  • Phone calls
  • Push notifications
  • In-app notifications

These communications may relate to account activity, campaigns, security, support, service updates, and promotional offers. You may opt out of promotional communications where permitted by law.

18. Limitation of Liability

To the maximum extent permitted by law, Khee Khee shall not be liable for:

  • Campaign outcomes
  • Creator performance
  • Business losses
  • Indirect or consequential damages
  • Lost profits
  • Loss of data
  • Third-party service failures
  • Unauthorized access resulting from user negligence

Our total liability shall not exceed the amount paid by the user to Khee Khee during the preceding twelve (12) months for the relevant service.

19. Indemnification

You agree to indemnify and hold harmless Khee Khee, its directors, employees, affiliates, and partners from claims, losses, damages, liabilities, and expenses arising out of:

  • Your use of the Platform
  • Violation of these Terms
  • Violation of applicable laws
  • Infringement of third-party rights

20. Suspension and Termination

Khee Khee may suspend or terminate any account if:

  • These Terms are violated.
  • Fraudulent activity is detected.
  • Required information is false or misleading.
  • Applicable laws require such action.

Users may stop using the Platform at any time. Termination does not automatically entitle users to refunds.

21. Modifications to the Platform

Khee Khee may modify, discontinue, add, or remove Platform features at any time. We do not guarantee uninterrupted availability of all services.

22. Changes to These Terms

We may update these Terms periodically. Updated versions become effective upon publication on the Platform. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.

23. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

24. Dispute Resolution

Any dispute arising out of these Terms shall first be attempted to be resolved amicably.

If unresolved, disputes shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Lucknow, Uttar Pradesh, India, unless otherwise agreed.

Courts located in Lucknow, Uttar Pradesh shall have exclusive jurisdiction over matters not subject to arbitration.
